1. Introduction

By using our privacy services, you agree to the terms and conditions below. If you do not agree, we kindly ask that you refrain from using our services and feel free to reach out to us for any clarification.

DEVPN reserves the right to update these terms, but is committed to running all changes through our DAO governance body, ensuring transparency by collecting a majority vote from our stakeholders.

Any changes to these terms and conditions will be communicated to our users via our website, GitBook, and social media accounts. Updated documentation will also be made available within our applications, and users will be notified through private messaging to ensure proper awareness.

2. Definitions

• "Service" or "Services" refers to the privacy and security solutions provided by DEVPN.

• "User" refers to any individual or entity using DEVPN services.

• "We/Us/Our" refers to DEVPN.

3. User obligations and responsibilities

Users must use our services responsibly and in accordance with all applicable laws and regulations. Prohibited activities include, but are not limited to, illegal activities, misuse of the service, and activities that harm or attempt to harm other users, the service, or the DEVPN ecosystem.

4. Account creation and management

4.1 Account registration: To use our privacy services, you must first create an account.

DEVPN highly recommends users to register using decentralized wallet authentication technology, ensuring full anonymity as outlined in our GitBook documentation. Alternatively, new users can register using the traditional method by providing a valid email address and creating a password.

Note: You are responsible for maintaining the confidentiality of your account information, password, any optional underlying accounts, as well as all activities that occur under your account.

4.2 Account security: You agree to notify us immediately of any unauthorized use of your account or any other security breach. While DEVPN employs advanced security measures to protect accounts, we cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation.

4.3 Account information: DEVPN does not require personal user data for registration.

Users who wish to receive notifications outside of our secure dApp messaging system are welcome to set up alternative communication accounts. However, we strongly recommend using decentralized authentication and our private messaging to ensure that our messages remain private and secure.

4.4 Account termination: If you violate these Terms and Conditions, our support team will contact you through private dApp messages to investigate and seek a resolution. However, to safeguard our ecosystem, we reserve the right to suspend or terminate your account at any time, with or without prior notice or liability. Upon termination, your access to our services will end immediately, and you will not be eligible for any (partial) refund.

If you wish to terminate your account, simply stop using our services. DEVPN does not process automatic payments or renewals, as we ethically oppose such corporate practices.

4.5 Multiple accounts: DEVPN allows users to create multiple accounts. However, we encourage customers to consider our premium packaged solutions for better value and enhanced features.

4.6 Parental control: Our services are intended for customers who are at least 18 years old. If you are under 18, you may use our services only with the permission and supervision of a parent or guardian, such as part of our One Home solution. DEVPN does not sell services directly to users under 18.

5. Service description

DEVPN offers privacy services designed to enhance user security and confidentiality. We provide the world's first hybrid ecosystem, combining the robust security and high-speed connectivity of data-center networks with the technical and organizational privacy benefits of decentralized networks.

6. Payment and billing

DEVPN supports a variety of payment options to accommodate global user preferences.

Our native $DEVPN token provides the greatest value and contributes most to our hybrid network.

We also accept traditional credit and debit card payments through third-party processors and are exploring prepaid credit card options for enhanced privacy in certain regions.

For crypto enthusiasts, we accept payments in Ethereum (ETH), Binance Coin (BNB), and major stablecoins on Ethereum and Binance Smart Chain.

Note: A small transaction fee is transparently applied (pending payment method) to cover conversion costs and ensure overall payment transparency, with the surplus reinvested into our ecosystem.

DEVPN does not support or process any form of recurring payments under any circumstances.

9. Security Measures

DEVPN employs extensive security measures, including advanced encryption standards, features from both centralized and decentralized technologies, and proprietary artificial intelligence (AI) implementations. 10. Intellectual Property

10.1 Ownership: All content, trademarks, service marks, logos, trade names, and other intellectual property displayed on our website and services are the property of DEVPN or its licensors. This includes, but is not limited to text, software, graphics, photos, sounds, music and videos.

10.2 License to use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for personal, non-commercial purposes. This license is contingent upon your compliance with these Terms and Conditions. Tailored licenses for commercial or organizational use are available upon request.

10.3 Restrictions: You agree not to copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

Any contributions made by DEVPN developers to open-source projects on external platforms are explicitly exempt from this rule. Our developers are both permitted and encouraged to collaborate on the development of open-source projects alongside industry peers.

10.4 User-generated content: By submitting, posting, or displaying content on DEVPN or on our privacy services, you grant DEVPN a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute such content in any and all media or distribution methods.

You represent and warrant that you have the right to grant this license and that the content does not violate the rights of any third party.

DEVPN is committed to properly crediting, tagging, or mentioning creative sources. We also ensure clear marketing campaigns for user contributions and creative content, with transparent competition or campaign rewards and rules designed to engage a wider community contribution.

10.5 Third-party intellectual property: We respect the intellectual property rights of others and expect our users to do the same. If you believe that your intellectual property rights have been infringed by content on our services, please contact us with a detailed description of the alleged infringement, and we will take appropriate action.

We apply the same ethical standards to competitors who may feel unfairly compared or treated due to perceived bias in our generalizations of decentralized and centralized commercial offerings. Providers who believe they too offer viable alternatives are encouraged to contact our team to explore mutually beneficial ways to provide customers with improved options transparently.

10.6 Feedback: Any public suggestions, ideas, or feedback provided by you to DEVPN regarding our services shall be deemed non-confidential, and we shall be free to use such information on an unrestricted basis without any obligation to compensate you.

Any similar actions conducted through our private messaging system within the user anonymity of our dApp will be treated with full confidentiality and are not subject to the rule mentioned above.

11. Limitation of Liability

The information provided in our documentation, social media, or applications is intended solely for educational and informational purposes. DEVPN expressly disclaims all liability for the use of our services for illegal purposes. Users assume all risks associated with their actions based on the content of our services.

12. Termination and Suspension

DEVPN reserves the right to terminate or suspend user accounts that violate these terms, engage in harmful activities towards other users, or participate in prohibited activities.

13. Changes to Terms and Conditions

We may update these Terms and Conditions periodically. Major changes are subject to oversight by our governance DAO and require a majority stakeholder vote. All updates will be communicated to our users via social media and reflected in the updated documentation within our applications.
